FOUR SEASONS CURLING CLUB
RELEASE OF LIABILITY WAIVER
In consideration of being allowed to participate in any way in the programs of Fogerty Arena, Four Seasons Curling Club at "The Ice House" (Club), Minnesota Curling Association, Inc. ("MCA"), and the United States Curling Association, Inc. (USCA), their related events and activities, the undersigned, acknowledge, appreciates, and agrees that:
1. The risk of injury from the activities involved in this program is significant, including the potential for possible exposure to illness from infectious diseases including but not limited to MRSA, influenza and COVID-19, permanent paralysis and death, and while particular skills, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist and that Fogerty Arena, the Club carries commercial liability insurance, that includes an athlete or sports participants exclusion;
and
2. I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the Releasees or others, and assume full responsibility for my participation;
and
3. I willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of Fogerty Arena, the Club, the MCA, and the USCA immediately;
and
4. I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, hereby release Fogerty Arena, the Club, the MCA, and the USCA, their officers, officials, agents and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of premises used for the activity (Releasees), with respect to any and all injury, disability, death, or loss or damage to person or property associated with my presence or participation, whether arising from the negligence of the Releasees or otherwise, to the fullest extent permitted by law.
I have read this release of liability and assumption of risk agreement, fully understand its terms, understand that I have given up substantial rights by signing it, and sign it freely and voluntarily without any inducement.

DIGITAL MEDIA WAIVER
I hereby grant Fogerty Arena, Four Seasons Curling Club, and Moe's Ice House permission to use my likeness in a photograph, video, or other digital media (“photo”) in any and all of its publications, including web-based publications, without payment or other consideration.
I understand and agree that all photos will become the property of the Fogerty Arena, Four Seasons Curling Club, and Moe's Ice House and the photos will not be returned. I hereby irrevocably authorize Fogerty Arena, Four Seasons Curling Club, and Moe's Ice House to edit, alter, copy, exhibit, publish, or distribute these photos for any lawful purpose. In addition, I waive any right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of the photo. I hereby hold harmless, release, and forever discharge Fogerty Arena, Four Seasons Curling Club, and Moe's Ice House from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization.
I HAVE READ AND UNDERSTAND THE ABOVE DIGITAL MEDIA RELEASE. I AFFIRM THAT I AM AT LEAST 18 YEARS OF AGE, OR, IF I AM UNDER 18 YEARS OF AGE, I HAVE OBTAINED THE REQUIRED CONSENT OF MY PARENTS/GUARDIANS AS EVIDENCED BY THIS CHECKBOX ACKNOWLEDGMENT.
Acknowledgment
I acknowledge that I have read and understand this agreement, that I have executed this agreement voluntarily, and that this agreement is to be binding upon myself, my heirs, spouse, children, parents, guardians, next of kin, executors, administrators, and legal or personal representatives. I further acknowledge by signing this agreement I have waived my right to maintain a lawsuit against the Organization on the basis of any claims from which I have released herein.
